When can you file a Notice of Termination (NOT)?

A Notice of Termination (NOT) ends your construction stormwater permit coverage. Under EPA's 2022 CGP you may file it only after you finish construction and meet final stabilization with photographs, remove construction materials, temporary controls and pollutants, or after you transfer the site to another covered operator or move to another permit. File within 30 calendar days of meeting a condition, in EPA's NeT system. EPA 2022 CGP Part 8.2, 8.3, 8.4

National guide. The rules cited are from EPA's 2022 Construction General Permit (as modified in 2025), checked October 20, 2026, which applies where EPA is the permitting authority. Most states issue their own permit with different details; check your state before relying on a number.

Conditions for terminating (EPA 2022 CGP Part 8.2)

Final vegetative stabilization means uniform, perennial vegetation providing 70 percent or more of the cover native to local undisturbed areas, or the equivalent non-vegetative measures. EPA 2022 CGP Part 2.2.14c

What the NOT contains

The NPDES ID from your coverage, the basis for termination, operator contact information, the site name and address (or a location description), and the NOT certification. EPA 2022 CGP Part 8.1

Deadline and effective date

Submit the NOT within 30 calendar days after a Part 8.2 condition occurs. EPA 2022 CGP Part 8.4 Coverage ends at midnight of the day a complete NOT is submitted. EPA 2022 CGP Part 8.5 Until then, every permit condition still applies. EPA 2022 CGP Part 8 File in NeT; paper NOTs need a Regional Office waiver. EPA 2022 CGP Part 8.3 Keep inspection reports for at least 3 years after coverage ends. EPA 2022 CGP Part 4.7.4
