Terms of Service
Effective date: October 20, 2026. Last updated: October 20, 2026.
1. Who we are
SWPPP Desk is a brand of Vertexium Environmental Solutions LLC ("we", "us", "our"). Krugerville, Texas. Email: [email protected].
These terms apply when you buy a plan from us or use swpppdesk.com. You accept them when you tick the terms box at checkout. If you order for a company, you confirm you can bind it.
2. The service
2.1 We prepare a written stormwater pollution prevention plan (SWPPP; in Texas, a SWP3) for one construction site. The plan is written for the construction stormwater general permit that covers the site. That is a state permit (for example, TCEQ TXR150000 in Texas) or the US EPA Construction General Permit where EPA is the permitting authority.
2.2 We prepare the plan from the facts, drawings and answers you give us. Plans are prepared by our team led by Mohamed Elansary, PhD. We are not a licensed engineering firm and do not seal plans. We use software tools, including AI drafting tools, for a first draft. A person reviews every plan against our written checklist before delivery.
2.3 Packages and prices (US dollars, one-time):
| Package | Site | Price |
|---|---|---|
| Small site | Disturbs 1 to under 5 acres | $449 |
| Large site | Disturbs 5 acres or more, or is part of a larger common plan of development of 5 acres or more | $749 |
Prices do not include government, permit or MS4 fees, or work outside the package. No interest or late fees are ever charged.
2.4 You get one SWPPP for one site, by email, as a PDF and an editable DOCX, ready for the operator to review and sign.
3. Where we work
3.1 We take orders only for sites in the states and on the terms listed in Schedule A. Schedule A is part of these terms.
3.2 Some states require a plan, or part of it, to be prepared, approved or sealed by a licensed or certified professional. Where Schedule A says "with your licensed professional", you must give us that professional's approved or sealed plan before we start. We then prepare the SWPPP around it. We do not act as that professional.
3.3 We do not take orders for sites in states listed as "not served" or "not yet served" in Schedule A.
4. What we do not do
4.1 We do not provide a professional engineer (PE) seal, sealed drawings, engineering design, or calculations.
4.2 We do not hold, and do not claim, any SWPPP-preparer, inspector or engineering licence or certification.
4.3 We do not visit or inspect sites, and we do not do the inspections the permit requires.
4.4 We do not sign, certify or file a Notice of Intent, Notice of Termination, site notice or any other permit document, and we do not pay any fee for you.
4.5 We do not give legal advice. We do not promise that any agency, MS4, lender or other party will accept the plan, that permit coverage will be granted, or that your site will be free of violations, inspections or penalties. See the Disclaimer .
5. Your part
5.1 The operator signs and certifies the SWPPP and all permit forms and notices. The operator gets permit coverage, puts the plan in place, keeps it up to date, does and records the inspections, keeps the records, and complies with the permit and all state and local rules.
5.2 You are responsible for the accuracy and completeness of what you give us, and for reading the plan before you sign it. You confirm you have the right to share the files you upload.
5.3 Tell us in writing if the site, its size, its receiving waters or its design changes.
6. Scope: check before you pay
6.1 We do not take sites that involve any of these:
- BMPs that need engineering design, such as sediment basins or other structures sized by calculation
- Discharges to impaired or 303(d)-listed waters
- Work in or affecting wetlands, streams or other waters
- A state or local rule that requires a sealed plan or a licensed or certified preparer, unless Schedule A allows the order with your licensed professional
- Data-center projects
- Sites outside the states served in Schedule A
6.2 Before checkout you confirm your state, your disturbed acreage, any limit that applies in your state, and that none of these apply. Please read them carefully, because all sales are final.
6.3 The checkout gate asks about each item before payment and does not open checkout if any applies or is unknown. If we later find that one applies, we tell you in writing, prepare the plan for the in-scope work and list in writing what your licensed professional must add.
6.4 If your site turns out to be in the larger size class, we ask you to pay the difference ($300) before we start. If it turns out to be in the smaller class, we deliver the plan for the price paid.
7. Payment and inputs
7.1 You pay in full at checkout by Stripe. We never see or store your full card number.
7.2 After payment you complete the intake form at /start/ and upload your drawings. Inputs are complete when we have the form, the drawings and answers to any follow-up questions.
7.3 We keep your order open for 12 months from payment. If inputs are still not complete after 12 months, the order closes.
8. Delivery
8.1 We aim to deliver by email from [email protected] on the next business day after your inputs are complete. A business day is Monday to Friday, Central Time, excluding US federal holidays.
8.2 The delivery date is a target, not a promise. If we are late, we keep working until we deliver.
9. All sales final; free revisions
All sales are final. We revise your plan free until it meets the stated scope. The stated scope is set by these terms and your order. To ask for a revision, write to [email protected] and say what is wrong. There is no deadline for fixing our own errors. If an agency or MS4 comments on the plan, send us the comments and we fix anything that is our error, free. Changes caused by new or changed site facts after delivery are new work; we quote them in writing before we start. Full details are in the Sales Policy .
10. Communication
All order communication is in writing, by email. We do not take calls. Addresses: [email protected] (help), [email protected] (orders and delivery), [email protected] (billing).
11. Use of the plan
On full payment you may use, copy and change the delivered plan for the site it was prepared for, and share it with your contractors, agencies and inspectors. We keep the rights in our templates, methods, website and reference content. You may not resell our templates or plans.
12. Limits on our liability
12.1 Our total liability for any claim about an order or the service is limited to the amount you paid for that order.
12.2 We are not liable for fines, penalties, stop-work orders, delays, lost profits, or indirect, incidental or consequential losses.
12.3 These limits do not apply to fraud, gross negligence or willful misconduct, or to any liability or consumer right that the law of your state does not allow to be limited or waived.
13. Disputes
13.1 Texas law governs these terms, without regard to conflict-of-laws rules.
13.2 Before filing any claim, write to [email protected] with your order details and what you want. We both try in good faith to resolve it within 30 days.
13.3 Any court case must be filed in the state or federal courts for Denton County, Texas, and you and we agree to those courts. Either of us may instead bring an individual claim in a small claims court (in Texas, a justice court) with jurisdiction.
13.4 Nothing here takes away a consumer protection right that the law of your state does not allow to be waived.
14. Who we serve
We may decline any order. We do not serve projects or companies whose main business is alcohol, tobacco, pork, gambling, cannabis, adult entertainment, or interest-based lending.
15. Free resources
Guides, templates, FAQs, the glossary and news on this site are general information, offered as is. They may not reflect the latest rule change in your state. Read the permit that applies to your site.
16. Changes
We may update these terms. The version shown at checkout when you pay applies to that order.
