What is a stormwater Notice of Intent (NOI)?
A Notice of Intent (NOI) is the operator's request for coverage under a construction general permit. Under EPA's 2022 CGP every operator submits a complete NOI through EPA's NeT system before construction starts: at least 14 calendar days before for a new site, with coverage beginning 14 days after EPA confirms it received a complete NOI. The SWPPP must be written first. EPA 2022 CGP Part 1.4, 1.4.1, 1.4.2, 1.4.3
National guide. The rules cited are from EPA's 2022 Construction General Permit (as modified in 2025), checked October 20, 2026, which applies where EPA is the permitting authority. Most states issue their own permit with different details; check your state before relying on a number.

Deadlines (EPA 2022 CGP Table 1)
| Operator | NOI due | Coverage begins |
|---|---|---|
| New site | At least 14 calendar days before construction starts | 14 calendar days after EPA notifies you it received a complete NOI, unless EPA delays or denies it |
| New operator of a permitted site (transfer) | At least 14 calendar days before the transfer | Same |
| Emergency-related project | Within 30 calendar days after construction starts | Provisionally covered at once; fully covered 14 days after EPA confirms a complete NOI |
EPA 2022 CGP Part 1.4.3, Table 1 If you miss the deadline, discharges are unauthorized until covered, and EPA may take enforcement action for the gap. Discharges are not authorized if the NOI is incomplete or inaccurate. EPA 2022 CGP Part Table 1, footnotes 9-10
How to file with EPA
Use EPA's NPDES eReporting Tool (NeT), reached through EPA's CDX at cdx.epa.gov. A paper NOI (Appendix H) is allowed only with a waiver from the EPA Regional Office, for limited broadband or computer access. EPA 2022 CGP Part 1.4.2
Before you file
- Write the SWPPP. EPA 2022 CGP Part 1.4.1
- Confirm eligibility, including the endangered species criteria and the historic property screening. EPA 2022 CGP Part 1.1.5-1.1.6
- Confirm the site is in an area where EPA is the permitting authority. EPA 2022 CGP Part 1.1.3
Changing or ending coverage
Correct or update an NOI with a "Change NOI" in NeT. Changes to the operator name, site name, disturbed area, receiving waters, endangered species or historic property information, chemical treatment, or pre-1980 demolition answers start a 14-day review before affected work can go ahead. A new operator files a new NOI and the previous operator files a Notice of Termination. EPA 2022 CGP Part 1.4.4 Coverage ends when you terminate it, move to another permit, or fail to re-file for a replacement permit by its deadline. EPA 2022 CGP Part 1.4.5 See Notice of Termination and the PROPOSED 2027 CGP for re-filing.
How state NOIs differ
Each state that issues its own permit runs its own NOI system and deadlines. In Texas, the primary operator of a large site (5 acres or more) files the NOI in STEERS before work starts, while small sites post a site notice instead of filing an NOI. TXR150000 Part II.E.2-3 Texas filing steps and fees are on TCEQ NOI: filing in STEERS. Other states: Alaska, Arizona, Arkansas, Colorado, Florida, Hawaii, Idaho, Illinois, Indiana, Iowa, Kentucky, Louisiana, Massachusetts, Michigan, Mississippi, Nebraska, Nevada, New Hampshire, New York, North Dakota, Ohio, Oklahoma, Oregon, South Carolina, South Dakota, Texas, Utah, Washington, West Virginia.
Our large-site plan includes an NOI worksheet and filing notes. You, the operator, file the NOI and pay any permit fee; we do not file for you.
How state permits differ: one example
| Rule | EPA 2022 CGP | Texas TXR150000 |
|---|---|---|
| Storm inspection trigger | 0.25 inch of rain in 24 hours (or snowmelt from 3.25 inches of snow) on the 14-day schedule EPA 2022 CGP Part 4.2.2 | 0.5 inch of rain on the 14-day schedule TXR150000 Part III.F.8(c) |
| Who files a Notice of Intent | All operators, at least 14 calendar days before work EPA 2022 CGP Part 1.4.3 | Primary operator of a large site (5 acres or more) before work; small sites post a site notice instead TXR150000 Part II.E.2-3 |
| Filing system | EPA NeT EPA 2022 CGP Part 1.4.2 | TCEQ STEERS TCEQ |
