TCEQ TXR150000 renewal: the Texas construction stormwater permit expires March 5, 2028
TCEQ has begun renewing TXR150000, the Texas construction general permit, which expires on March 5, 2028; the current permit took effect March 5, 2023. TCEQ shared preliminary proposed changes at a June 9, 2026 stakeholder meeting. They are not permit text, and no draft permit had been posted as of October 20, 2026. What TCEQ has preliminarily proposed (June 9, 2026 handout)
These are preliminary; TCEQ marked several as "Requesting feedback". TCEQ handout, Preliminary Proposed Changes to the 2028 Permit
- The SWP3 would carry the signed statement required by 30 TAC §305.128, "to align requirements with the EPA CGP and TCEQ MSGP".
- A new, separate Part IV for inspection and evaluation requirements, which now sit inside "Contents of the SWP3".
- Final stabilization: remove part (b), so homebuilder hand-offs go through Transfer of Operational Control; add native plants or seeding; define "large bare areas" (preliminary text: "larger than 10 sq ft").
- Termination: remove the option to schedule removal of temporary controls after the NOT, and add incentives to file NOTs.
- Biodegradable erosion and sediment controls where feasible, such as natural-fiber silt fence.
- An Endangered Species Act acknowledgment statement in the SWP3.
- More Notice of Change examples, including any change to the NOI's General Characteristics section.
- Site notices: the 30 TAC §305.44 certification statement on the large and small Construction Site Notices, plus primary and secondary check boxes on the small notice.
- A flow chart note to check local authorities for stricter rules, and possible Regulatory Guidance on "common plan of development".
What this means for active Texas sites
Sites covered under the 2023 permit that are still active near March 5, 2028 will need to move to the 2028 permit on terms TCEQ sets in the renewed permit; those terms are not published yet. If the preliminary changes survive, expect SWP3 updates for the certification statement, the separate inspection part, the stabilization definition and the ESA statement. Today's rules are on the TXR150000 page.
We write SWP3s to TXR150000 and map each section to the permit part it answers. When TCEQ issues the 2028 permit, we will write plans to its text. You, the operator, sign the plan, post the site notice and file the NOI in STEERS; we do not file for you.
What this page does not cover
The final 2028 permit (not issued yet), local city or county rules, and industrial permits. The 2028 items on this page are TCEQ's preliminary proposals, not permit text.
