Checked October 20, 2026 against the permit text published by Michigan Department of Environment, Great Lakes, and Energy. Sources and sections are listed at the end of this page.
In Michigan, construction stormwater coverage comes from Permit-by-Rule for Storm Water from Construction Activities (R 323.2190) with a Part 91 SESC permit (permit no. R 323.2190 (Notice of Coverage for 5+ acres)), issued by Michigan Department of Environment, Great Lakes, and Energy (EGLE). It is an administrative rule in force (EGLE copy revised 9/2022) with no expiry date.
Where we can help. You obtain the local Part 91 SESC permit and supply an EGLE-certified storm water operator for supervision and inspections (R 323.2190(2)(d)-(e)). County or city SESC agencies may add their own plan rules, which we check before you order.
At a glance
| Item | What the permit says |
|---|---|
| How coverage is obtained | Coverage by rule once the local Part 91 agency issues the soil erosion and sedimentation control (SESC) permit; 5+ acres also file a Notice of Coverage before construction; 1 to 5 acres are automatically covered (R 323.2190(1)) |
| Agency fee | Not stated in the sources we checked. |
| Who may prepare the plan | 'A person shall prepare a soil erosion and sedimentation control plan' (R 323.1703); no licence named. The local Part 91 agency approves it |
| Who inspects | Certified storm water operator (certified by EGLE) supervises the controls and inspects (R 323.2190(2)(d)-(e)) |
| Inspection frequency | Once per week and within 24 hours after every precipitation event that causes a discharge (R 323.2190(2)(e)) |
| State forms and templates | No mandatory state SWPPP template named in the permit |
Points that are easy to miss
- Coverage depends on a local Part 91 SESC permit (R 323.2190(2)(b)).
- The Notice of Coverage for 5+ acres must name a certified storm water operator (R 323.2190(1)(a)(vii)).
- Inspections are weekly and within 24 hours of any discharge-causing rain (R 323.2190(2)(e)).

What we do not do
- Our plans are not sealed or stamped. BMPs that need design calculations, such as sediment basins and post-construction practices, come from your design professional.
- The operator signs the plan and is responsible for it.
- We do not visit or inspect sites.
- We do not file the NOI or any permit application for you. We tell you which form and portal the permit names.
