FDEP NOI: filing for Florida construction stormwater coverage
In Florida, construction disturbing one acre or more, or less within a larger common plan, that discharges to surface waters or an MS4 needs coverage under DEP's Construction Generic Permit. FDEP construction activity page You get it by filing DEP Form 62-621.300(4)(b), the Notice of Intent, with a $400 fee for 5 acres or more or $250 for 1 to 4.99 acres, at least 2 calendar days before construction starts, after your SWPPP is written. Filing step by step
- Confirm the site needs coverage: one acre or more disturbed (or part of a common plan) and a discharge to surface waters or an MS4. FDEP page
- Have the SWPPP written and ready to implement. FDEP CGP Part 2.2
- Decide whether you will dewater; if you will discharge groundwater, confirm the site is not a contaminated site and has none within 500 feet (or that DEP has documented remediation), and fill in NOI Part VI. FDEP CGP Part 3.4.2-3.4.3
- Have the responsible authority sign, or a designated representative. FDEP CGP Part 2.4
- File the NOI and fee in the DEP Business Portal, or mail them, at least 2 calendar days before construction. FDEP CGP Part 2.3, 2.5.1
- When the acknowledgment arrives, post it (or the NOI) at the site and send a copy to the MS4 operator within 7 days if you discharge to one. FDEP CGP Part 2.6.3-2.6.4
Proposed rule changes
DEP is proposing amendments to Chapter 62-621, F.A.C., that would update the Construction Generic Permit and its NOI and NOT forms. A public workshop was held November 19, 2025, comments were taken until December 30, 2025, and DEP posted a revised draft rule dated July 22, 2026. FDEP CGP rulemaking drafts page Until DEP adopts a new permit, the 2015 permit and forms above apply. Check the rulemaking page before you file.
What we do
We prepare Florida CGP SWPPPs, written before your NOI as Part 2.2 requires. We prepare the plan document. We do not stamp plans, visit sites or file the NOI; you file it. The site check at checkout applies the Florida limits shown on the Florida hub before payment.
