MSR10: Mississippi large construction stormwater permit

MSR10 is the Large Construction Storm Water General Permit the Mississippi Department of Environmental Quality (MDEQ) issues for construction disturbing 5 acres or more, or less than 5 acres within a larger common plan of development or sale. MSR10 ACT1 T-1 It was issued February 4, 2022 and expires January 31, 2027. MSR10 cover page Coverage starts only when MDEQ sends written notification, and the site-specific SWPPP is submitted with the application. MSR10 ACT4 S-1, S-2 Checked October 20, 2026.

Who appliesOwners and/or operators. The operator is typically the prime contractor; the owner may file the LCNOI and the operator later files a Prime Contractor Certification accepting joint and severable responsibility. Every operator on the project needs coverage; subcontractors generally are not operators. Projects with multiple operators submit a group SWPPP unless MDEQ approves otherwise.MSR10 ACT3 S-1
What you submitA Large Construction Notice of Intent (LCNOI) with the site-specific SWPPP and a USGS quad map (or color copy) extending at least half a mile beyond the property boundaries, with the site outlinedMSR10 ACT4 S-2
How to submitForms at mdeq.ms.gov/construction-stormwater/ (601-961-5171). After December 21, 2025, the forms are submitted electronically through that web addressMSR10 ACT4 T-1, T-2
When work can startDischarging stormwater without written notification of coverage is a violation. Coverage is not granted until other required MDEQ permits and approvals are addressedMSR10 ACT4 S-1, T-1
FeeNone. MDEQ's guidance manual says its general permits do not require a fee at this timeMDEQ SWPPP guidance manual, FAQ p. 25
Plan standardA site-specific SWPPP prepared in accordance with sound engineering practices. The permit text names no preparer licenceMSR10 ACT5 T-1
InspectionsBy qualified personnel on MDEQ's form (or equivalent): at least weekly for a minimum of four per month, after rain events that produce a discharge, and as often as needed. MDEQ strongly recommends a daily walk-throughMSR10 ACT6 S-5; ACT5 T-16
RepairsDeficiencies corrected as soon as possible, not to exceed 24 hours of the inspection unless unsafe weather prevents it and that is documented on the formMSR10 ACT5 T-16
Sediment basinsDrainage locations serving 10 or more disturbed acres at one time need a basin of at least 3,600 cubic feet (133 cubic yards) per acre drained, installed before initial grading. Linear projects are not required to use basinsMSR10 ACT5 T-6(2)(A)-(B)
RecordsKept at least 3 years; inspections documented on the Monthly Inspection Report and Certification FormMSR10 ACT9 R-1, S-2
TerminationRequest for Termination with color photographs of the stabilized site within 30 days of final stabilization. Coverage ends only when MDEQ notifies you in writingMSR10 ACT10 S-1

The January 31, 2027 expiry

If MDEQ has not reissued MSR10 by its expiration date, existing coverage continues until the reissued permit takes effect. Once it is reissued, active coverage recipients receive a Recoverage Form with a Letter of Instruction, and return it as instructed to stay covered. MSR10 ACT3 S-3 SWPPP resubmittal is not required if the SWPPP is on site or locally available, current, and adequately addresses the site's pollution sources, though some SWPPPs may need amendments to meet the reissued permit. MSR10 ACT3 S-3

What the SWPPP must show

MSR10 asks for a scaled site map with a north arrow, original and proposed contours where feasible, drainage arrows, sensitive areas, inlets and the receiving MS4, all erosion and sediment controls, post-construction controls, the construction entrance, concrete washout, waste, laydown and chemical storage areas, and buffer zones. MSR10 ACT5 T-13 Dewatering follows the eight items in ACT5 T-11. MSR10 ACT5 T-11 See also SWPPP site map requirements and sediment basins.

What we do

We prepare MSR10 SWPPPs for large Mississippi sites (5 acres or more). Small sites fall under a separate permit, MSR15, which we do not offer yet. Runoff and post-construction calculations, and the design of post-construction controls, come from your project designer. We do not calculate or design them (Terms 6.1); the plan lists them as items your designer supplies. We prepare the plan document. We do not stamp plans, visit sites or file the NOI; you file it. The site check at checkout applies the Mississippi limits shown on the Mississippi hub before payment.

Questions

Is there a fee for MSR10 coverage?

No. MDEQ's SWPPP guidance manual says its general permits do not require a fee at this time.

Can I start work as soon as I submit the LCNOI?

No. MSR10 says discharging stormwater without written notification of coverage is a violation, so wait for MDEQ's written coverage.

How often must an MSR10 site be inspected?

At least weekly for a minimum of four inspections per month, after rain events that produce a discharge, and as often as needed, by qualified personnel on MDEQ's form.

What happens when MSR10 expires on January 31, 2027?

If it is not reissued by then, coverage continues until the reissued permit is effective. After reissuance, MDEQ sends active permittees a Recoverage Form with a Letter of Instruction.

Does SWPPP Desk write plans for small Mississippi sites?

Not yet. Sites under 5 acres fall under MSR15, which we have not verified, so only large sites under MSR10 are offered.
